Wersja polska · Privacy Policy
Version 1.3. Effective from 12 November 2026 (the previous version was effective from 24 October 2026).
These terms set out the rules for the electronic services provided in the Gribo app. They are terms of service within the meaning of Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services. We make them available free of charge before you start using the app, in the app (Settings → About) and at https://gribo.app/en/terms/, in a form you can download, save and print. The Polish version prevails in case of discrepancies.
Service provider
The services are provided by Key Data Krzysztof Kacprzak, a sole proprietorship, ul. Włodarzewska 87B/66, 02-393 Warsaw, Poland, NIP (tax ID) 9482228490, REGON 367226330, registered in the Polish Central Register and Information on Economic Activity (CEIDG) (“we”). Phone: +48 22 102 18 58.
Contact (support, complaints, privacy, content reports): support@gribo.app or “Write to us” in the app Settings. This address is also the single point of contact for users and authorities under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act). You can contact us in Polish or English.
What Gribo is
Gribo is an educational app about mushrooms. It helps you learn species and warns about hazards: poisonous species, poisoning and protected species. The app and its basic features are free. On Android we offer optional paid digital content (see “Paid digital content”).
As part of Gribo we provide:
- The app running on your phone: the species Atlas, a recognition hint from a photo (the model runs on the phone), the map, outings, a finds journal, games and ranks, a local backup.
- Online services through our server:
- delivery of encrypted messages, spots, invitations and trade offers between friends;
- group outings with position sharing within the group;
- the community map — publishing entries you share yourself; in new installs sharing is on by default in “region” mode (an area of about 250 km², species and month, no nickname or mushroom count, no protected species) — the app tells you about it on first start, and you can turn it off in Settings (“Sharing my data”);
- “I want to join” — announcing that you are looking for an outing (Android);
- cloud backup (Android);
- the stylized avatar (only for people aged 16 or over);
- the “Write to us” form and species reports for the Atlas;
- requesting full access (Android).
Features may differ between Android and iOS. On iOS there are currently no payments, no full access and no nickname on the community map.
The app and gribo.app also offer Clean Forest: reporting illegal waste dumps to municipalities and a public map of the reports. It is governed by the Clean Forest Rules (in Polish, https://gribo.app/czysty-las/regulamin/), which supplement these terms and prevail in matters concerning Clean Forest.
Technical requirements
To use Gribo you need:
- a phone with Android 10 or later, or an iPhone with iOS 16 or later;
- the app downloaded from Google Play or the App Store, preferably the current version;
- an internet connection — for online services, maps, 3D models and weather (other features work offline);
- phone permissions for the features you choose (camera, location, photos, microphone, motion, notifications).
Older app versions may lose access to online services when the server protocol changes. The app will then ask you to update.
Conclusion and termination of the agreement
The service agreement is concluded for an indefinite period when, having read these terms, you start using the app. An online service is provided from the moment you first use it.
You may terminate the agreement at any time, without giving reasons and at no cost: use “Delete my data from the server” and uninstall the app. You may also stop using any single online service.
We may terminate the agreement or block your device’s access to online services only for important reasons:
- a serious or repeated breach of these terms, in particular providing unlawful content or abuse that burdens the server — with immediate effect if the breach endangers other users or the operation of the service; otherwise after an unsuccessful request to stop;
- discontinuation of the whole service or of a given online feature — with 30 days’ notice given in the app;
- an obligation under the law or a court or authority decision — within the period resulting from that obligation.
We will inform you in the app about the decision and its reasons (Article 17 of the Digital Services Act). You can challenge it through the complaint procedure. Features that run on the phone will keep working.
Mushroom safety
Gribo does not assess whether mushrooms are edible. Species recognition is only a hint — the model can be wrong, including with deadly poisonous species. The decision to eat is yours. Before eating, show the mushroom to a mushroom expert (in Poland, e.g. at a sanitary-epidemiological station). If you suspect poisoning, call the emergency number 112 immediately.
Forests and the law
Follow the rules on forests, national parks, reserves and species protection, and respect landowners’ rights. Leave protected species where they grow. Do not enter areas where access is prohibited.
Rules of use and unlawful content
Providing unlawful content through Gribo is prohibited (Article 8(3)(2)(b) of the Act on the provision of electronic services). In particular, you must not:
- send or publish content that infringes the law, personal rights or other people’s copyright;
- send photos of other people without their consent or — under any circumstances — photos of children for the stylized avatar;
- use offensive or misleading nicknames or impersonate other people;
- publish on the community map places whose disclosure endangers protected species or infringes landowners’ rights;
- circumvent server safeguards and limits, overload the server, scrape the community map, or use the server for anything other than running the app.
The server applies limits that protect against abuse.
Reporting illegal content
If you see content on the community map, in an “I want to join” entry or in a nickname that you consider illegal or contrary to these terms, report it to support@gribo.app or via “Write to us”. State where the content is, why you consider it illegal, and your name and email (except for reports concerning child sexual abuse). We will handle the report without undue delay and objectively, and inform you of our decision (Article 16 of the Digital Services Act). You report content in Clean Forest (sites, photos, comments) under § 6 of the Clean Forest Rules. We do not use automated content moderation, except for the temporary automated measures in Clean Forest described in § 5(3) of the Clean Forest Rules (https://gribo.app/czysty-las/regulamin/). The final decision to remove or restore content is always taken by a human.
Messages between friends are end-to-end encrypted — we do not know their content and cannot moderate it. If you receive illegal content from a friend, you can remove them from your friends list and report the matter to law enforcement.
Specific risks
We inform you about risks related to using electronic services (Article 6 of the Act on the provision of electronic services):
- community map entries and “I want to join” entries are visible to other people — think before revealing your nickname or area;
- during a group outing, participants may see your position — join only people you trust;
- losing your backup password means losing access to the backup — we cannot decrypt it;
- like any software connecting to the internet, the app may be exposed to malware on the phone or in the network — keep the system and the app up to date;
- in the forest, GPS and coverage can be unreliable and the battery runs out — do not rely solely on the app for orientation.
Licence and rights
We grant you a free, non-exclusive, non-transferable licence to use the app for your own private, non-commercial use for the duration of the agreement. Paid content is covered by the same licence, to the extent of the item purchased. Commercial use (e.g. in a business, paid services or training) requires a separate licence — write to us.
The app, its code, recognition models, graphics and texts are protected by copyright and belong to Key Data. “Gribo” is the name of the app used by Key Data. You may not use it in a way suggesting a connection with Gribo without our consent.
The exception is educational material about mushrooms — the Atlas descriptions and illustrations prepared by Key Data. You may use them, also outside the app, crediting “Gribo” as the source and respecting the licences of third-party materials. Species photos come from iNaturalist and Wikimedia Commons under CC0 and CC BY licences (authors are credited in the Atlas). Maps © OpenStreetMap contributors.
You may not modify, decompile or distribute the app beyond what mandatory law allows.
Paid digital content (Android)
What we sell
- The Gribo app and its basic features are free and contain no ads. In the Android version you can also buy digital content within the meaning of Article 2(5) of the Polish Consumer Rights Act (“paid content”). It does not affect safety or the app’s educational features. We currently offer:
- appearance skins (forest and character skins): they change how the app looks;
- additional avatars;
- additional hero profiles: your first profile is free, every further one is paid;
- outing seats pack: raises the participant limit of every group outing you start by 5 people (up to 12 people per outing in total). You can buy it more than once;
- creator tips (Chanterelle, Parasol, Porcini): see “Tips”.
- The description, price and function of each item are shown in the app before purchase. That description forms part of the contract.
- Paid content works in the Gribo app on Android 10 or later, with Google Play and a signed-in Google account. It does not work in the iOS version or outside the app. It cannot be transferred to another Google account or resold.
Who you contract with and who collects payment
- You conclude the contract for paid content with Key Data Krzysztof Kacprzak (see “Service provider”). We are responsible for paid content and its conformity with the contract.
- Purchases are made only through Google Play’s billing system. Google collects and settles the payment as our agent, under Google Play’s terms. Available payment methods depend on Google Play and your country. We do not receive your card or other payment instrument details.
- The contract is concluded when you confirm the purchase with the payment button in the Google Play window (e.g. “Buy”). If you choose a deferred payment method (e.g. cash at a Google partner outlet), we deliver the content once Google confirms the payment.
Prices
- All prices include taxes. We charge no additional fees. Prices in Poland: forest skin PLN 10, character skin PLN 5, additional avatar PLN 5, additional hero profile PLN 10, outing seats pack PLN 5, tips: Chanterelle PLN 10, Parasol PLN 20, Porcini PLN 50.
- Outside Poland, Google Play shows the price in your local currency, converted according to the regional price list. The price shown in the Google Play payment window at the time of purchase is binding. We do not personalise prices on the basis of automated decision-making.
- Price changes do not affect purchases already made.
Delivery
- We deliver paid content without undue delay once Google confirms the payment, by unlocking it in the app on the device used for the purchase.
- Skins, avatars and hero profiles are one-time purchases that you can use for an unlimited period for as long as you use the Gribo app on Android (see point 24 for discontinuation). A purchase is linked to the Google account used to make it. On a new phone or after reinstalling, the app restores it automatically through Google Play (Settings → “Restore purchases”) when you sign in with the same Google account.
- The seats pack and tips are single-use purchases. Their effect is stored on the phone. Google Play does not restore them on another device or after reinstalling the app.
- If paid content does not appear within 24 hours of payment confirmation, contact us (see “Complaints about paid content”).
Consent to immediate delivery and the right of withdrawal
-
As a rule, a consumer who concludes a distance contract may withdraw from it within 14 days without giving a reason (Article 27 of the Polish Consumer Rights Act).
-
We deliver paid content immediately. Before you proceed to payment, we therefore ask you to:
- give your express consent to delivery starting before the withdrawal period ends, and
- acknowledge that you lose your right of withdrawal once delivery starts.
You cannot proceed to payment without this consent.
-
Once you have given this consent, delivery has started and you have received the purchase confirmation (point 17), you have no right of withdrawal (Article 38(1)(13) of the Polish Consumer Rights Act). This does not affect your rights if the content does not conform to the contract, or the option of a refund through Google Play (points 19–22).
-
After the purchase, the app gives you confirmation of the contract on a durable medium: a file saved on your phone, which you can also share or email to yourself. It states the seller’s details, the item and price, the Google Play order number, the purchase date, the consent you gave and a link to the terms as they stood on the purchase date (Article 21(1) of the Polish Consumer Rights Act). Google Play also sends its own payment receipt to the email address of your Google account.
17a. If delivery has not yet started (e.g. with deferred payment), or you otherwise have a right of withdrawal, you can exercise it by sending a statement to support@gribo.app or by post to Key Data’s address. You may, but need not, use the model withdrawal form in Annex 2 to the Polish Consumer Rights Act. We will refund the payment within 14 days by the same payment method (through Google Play). From withdrawal you must stop using the content, and we may disable it in the app.
Tips
- Tips (Chanterelle, Parasol, Porcini) are voluntary and support the app’s development. In return you get only a decorative badge next to your avatar. A tip does not unlock any feature and gives no priority support or influence on the app’s development. All provisions of this section apply to tips, including those on withdrawal, complaints and refunds.
Complaints about paid content (conformity with the contract)
- We are liable for the conformity of paid content with the contract under Chapter 5b of the Polish Consumer Rights Act (Articles 43h–43q), for any lack of conformity that existed at delivery and becomes apparent within 2 years of it (Article 43l(1)). We provide the updates needed to keep the content in conformity (Article 43k(3)).
- If paid content does not conform to the contract (e.g. it does not work, was not unlocked or does not match its description), you may:
- demand that it be brought into conformity (Article 43m);
- declare a price reduction or withdrawal from the contract in the cases set out in Article 43n, in particular if we fail to bring it into conformity. You cannot withdraw if the lack of conformity is minor (Article 43n(3)).
- Send complaints to support@gribo.app or via “Write to us”, with your Google Play order number (GPA…), a description of the problem and your request. We will reply within 14 days of receipt, by email or on another durable medium (Article 7a of the Act). We will refund any price due within 14 days of receiving your statement, by the payment method you used, i.e. through Google Play (Article 43o(6) and (7)).
Refunds through Google Play
- Regardless of your statutory rights, you can request a refund directly from Google Play, within the time limits and under the rules of Google Play (play.google.com → Order history). Google decides on refunds requested this way. A refusal by Google does not limit your rights against us under points 16–21. If a payment is refunded or reversed, the paid content may be disabled in the app.
Discontinuation of the app or of content
- We do not change paid content you have bought to your disadvantage. We only make updates needed to keep it in conformity with the contract (Article 43p(1) of the Act).
- If we stop providing Gribo or withdraw a paid item, we will notify you in the app at least 30 days in advance. For content bought within 24 months before we stop providing the services, we will refund the price at your request. This does not limit your rights regarding lack of conformity under points 19–21.
Changes to the terms and purchases
- We change these terms under “Changes to these terms”, notifying you in the app at least 14 days before the change takes effect. Changes apply to purchases made after they take effect. Earlier purchases remain governed by the terms in force on the purchase date, unless the new version is more favourable to you.
Full access
- Full access (Android) is a free, voluntary unlocking of additional features at your request. We may revoke it for the important reasons listed under “Conclusion and termination of the agreement”. Ending full access because a feature is withdrawn or becomes paid will be announced 30 days in advance.
Liability
We make every effort to keep the app and server working correctly and without interruption. The online services are free, however, and may have technical breaks, e.g. during updates or outages of our providers. Where possible, we will announce longer planned breaks in the app.
We are liable as provided by law, in particular the Polish Civil Code. These terms do not exclude or limit our liability for personal injury or for damage caused intentionally, nor any of your consumer rights that cannot be excluded by contract.
Information in the app, including the recognition hint, is educational and does not replace a mushroom expert’s assessment (see “Mushroom safety”).
We do not know the content of encrypted messages exchanged between users. For content published by users, we are liable to the extent set out in Article 6 of the Digital Services Act.
Complaints
Send complaints about the services by email to support@gribo.app or via “Write to us”. Describe the problem, what you expect, and an email address for the reply.
We will handle the complaint within 14 days of receiving it and reply by email. If information needed to handle it is missing, we will ask you to complete it — the period then runs from receipt of the completion.
For complaints about paid content, see “Paid digital content”.
As a consumer in Poland you may also use the free help of a municipal or district consumer ombudsman, the regional Trade Inspection, or out-of-court dispute resolution (information: uokik.gov.pl). The complaint procedure does not limit your right to go to court.
If payments are introduced, disputes about App Store payments will be handled by Apple under its rules.
App Store version
If you downloaded Gribo from the App Store, the following also applies:
- the agreement is between you and us, not Apple; we, not Apple, are responsible for the app and its content;
- the licence covers use of the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the extent permitted by law, Apple has no other warranty obligation regarding the app;
- we, not Apple, are responsible for addressing claims relating to the app (including product liability, legal or regulatory non-compliance and consumer protection claims) and third-party claims that the app infringes intellectual property rights;
- you confirm that you are not located in a country subject to a US Government embargo and are not listed on any US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
We may change these terms only for important reasons:
- a change in the law that affects the terms;
- a court ruling, decision or recommendation of a public authority;
- introducing new features or services, including paid ones, or changing or withdrawing existing ones;
- a change of technical providers or of how the server works;
- the need to ensure security or prevent abuse;
- a change of the provider’s details or editorial corrections.
We will notify you of a change in the app at least 14 days before it takes effect, describing its scope. Until then you may terminate the agreement at no cost (see “Conclusion and termination of the agreement”). Changes do not apply retroactively. We use a shorter period only where the law or an authority’s decision requires it.
Final provisions
The agreement is governed by Polish law. This choice of law does not deprive a consumer of the protection of mandatory provisions of the country of their habitual residence. Disputes are resolved by the courts having jurisdiction under general rules.
How we process personal data is described in the Privacy Policy: https://gribo.app/en/privacy/. The current terms are always in the app and at https://gribo.app/en/terms/.
